Dana S. Durrett is Of Counsel in the firm’s Healthcare Practice, where he focuses his practice on litigation, regulatory, administrative and transactional matters. Mr. Durrett has practiced healthcare law for nearly 15 years, and has represented a broad array of healthcare providers in many substantive areas. His clients include hospitals, physician practices, ambulatory surgery centers, nursing homes, assisted living facilities, medical device manufacturers and insurance companies.

Mr. Durrett has experience litigating medical malpractice, professional negligence, and False Claims Act actions, as well as commercial healthcare matters. Likewise, in administrative matters, Mr. Durrett has experience litigating Certificate of Need, recoupment, and licensure matters.

From a transactional standpoint, Mr. Durrett has experience representing hospitals, physician practices and healthcare companies in mergers, acquisitions and employment matters. Furthermore, Mr. Durrett regularly negotiates commercial agreements on behalf of healthcare providers.

Finally, Mr. Durrett regularly advises clients regarding complex regulatory issues, including HIPAA, billing and coding, Anti-Kickback Statute, Stark Law and Medicare / Medicaid compliance.

  • Conducting internal investigation of physician practice regarding HIPAA violations;
  • Training vendor to healthcare companies regarding HIPAA breach notification and related privacy matters;
  • Representing providers in government investigations and prosecutions before DOJ;
  • Representing provider in negotiation of management and credit facility agreement;
  • Advising and training hospitals and physicians regarding Stark Law, Anti-Kickback Statute and HIPAA;
  • Representing providers regarding Certificate of Need applications and appeals;
  • Representing Part B companies in Medicare / Medicaid enrollment, surveying and certification;
  • Counseling national and regional hospital and long-term care providers in administrative appeals, licensure sanction actions, Certificate of Need, and Medicare/Medicaid enrollment.
